General terms and conditions of sale (GTC)

Article 1: Offer

The company Mon Chauffeur Privates for the purpose of transporting people for a fee, for this it makes available to users, via its website ,a vehicle booking software with drivers for individuals and professionals.

Article 2: Reservation

All reservations must be made by the Customer or by a duly authorized representative. For any reservation, the customer must provide the following information : Customer information : Last name, first name, phone number, email, and residence address. Information about the route : Date and time of pick-up, place of departure and arrival, number of passengers, need for booster seat, number of luggage, as well as the flight or train number if applicable.  

Article 3: Cancellation and modification

The customer can request the cancellation of the service up to 24 hours before the date and time of pick-up and obtain a refund of the sums paid. Regarding the cancellation of the service less than 24 hours before the date and time of pick-up, 50% of the total amount of the quote will be due, as a fixed and fixed penalty. Regarding the cancellation of the service less than 2 hours before the date and time of pick-up, the entire amount of the quote will be due, as a fixed and fixed penalty. The service provider may cancel the customer’s transport in the event of force majeure, in which case the customer may benefit from compensation. He can also cancel the transport if the customer does not show up at the agreed place, beyond a deadline set at 15 minutes. In the latter case, the customer will be invoiced for his failure to comply. Any modification of the journey by the customer during the service and resulting in changes in the program, may result in supplements to be paid on site or at the end of the service.

Article 4: Provision

Any provision of services must be the subject of a written reservation. It must be carried out by the customer or by a duly authorized representative. All reservations must mention the place of performance of the service, the number of passengers and the name and contact details of the beneficiary of the service if it is different from those of the customer. Any cancellation of provision must be notified 48 hours before the start of the service. Failing this and for whatever reasons, it will be due, as a fixed and fixed penalty, non-deductible equal to the amount initially provided for when booking. The service is valid only once, and if it turns out that the client was not present at the place of appointment, the service would be definitively lost and will not give any right to refund. Any waiting, beyond a deductible of one hour, will be invoiced on the hourly basis mentioned in our rates for the category of the reserved vehicle.

Article 5: Prices

The rates communicated by our booking module are given as an indication and may vary depending on the period or the desired schedule, to obtain confirmation of the rates the customer will have to make an online quote request via the contact form CONTACT US. The transfer rate applies to direct non-stop travel from the pick-up point to the point of arrival, with the service ending immediately afterwards. The amount of luggage carried is proportional to the capacity of the vehicle. The prices indicated include the vehicle, the driver service, the insurance for the people transported, the fuel, the kilometers and the time determined during the reservation and / or during the conclusion of the contract as well as the transport of the customer’s luggage within the limits of the possibility of the vehicle. The cost of tolls, parking, parking places or entrance in some places chosen by the customer and / or made essential for the performance of the service not initially provided for in the journey remain the responsibility of the customer. The price given corresponds to a price per vehicle, regardless of the number of people (from 1 to 4 people for the SEDAN range for example) Note that all the photos communicated on our documents and website are for illustrative purposes and not contractual.

Article 6: Rules

For occasional customers, our services are payable on booking (online payment via Stripe) or on board the vehicle by credit card (payment by TPE via SumUp) or by cash. For customers on account, invoices are payable upon receipt by bank transfer. Any invoice not paid within 5 days of the invoice date of the service automatically entails the application of penalties of € 40 and an amount equal to 3 times the legal interest rate. In any case, the customer, the signatory of the reservation, is solely responsible for the payment of the service

Article 7: Limitation of liability clauses

My Private Driver undertakes to do everything necessary to take the passenger to his destination as soon as possible and in optimal safety conditions in accordance with the Highway Code and the laws in force. Mon Chauffeur Prive can in no way be held responsible for delays in transport times due to circumstances beyond its control: blocked road, bridge prohibited to traffic, diversion, flooded road, traffic jams, interventions on the roadway of police forces, customs or firefighters, etc … (without this list being limiting). Mon Chauffeur Prive can in no way be held responsible for delays due to force majeure: strikes, weather conditions, attacks, riots, etc … (without this list being exhaustive). Mon Chauffeur Prive can in no way be held responsible for delays directly resulting from an initial delay by a customer, or the need to make a trip, at the request of the customer, within a clearly too short time. In the event of immobilization of the vehicle during the journey due to a mechanical failure, an accident or damage (theft, degradation), My Private Driver will endeavor to ensure the continuity of the journey, either with one of these vehicles, or with a vehicle chartered to another company and undertakes to notify the instructing party. The luggage or any other object belonging to the customer remain under the responsibility of the person transported. The driver is obliged to comply with the various regulations applicable to the movement of vehicles and ensure, as part of the performance of the service, to take the necessary measures to preserve the safety of the occupants of the vehicle and the proper conservation of the latter. Thus, the driver expressly reserves the right to refuse any instructions and / or requests from the customer that he considered likely to compromise the safety of the occupants of the vehicle and / or the good conservation of it. The number of authorized passengers (including the driver) is the one indicated in the technical characteristics of the Vehicle. It can never be surpassed. Damage of any kind caused to the vehicle and / or other vehicles (for example, during the untimely opening of the doors) will be the responsibility of the customer unless it is demonstrated that they come from the fact of a third party. The occupants of the vehicle, the attendants, service providers and guests of the customer cannot be considered as third parties. Mon Chauffeur Prive reserves the right to interrupt the current service if the driver realizes that the customer is committing an offense, for example the use of narcotics, or if the behavior of the customers jeopardized the safety of the driver, or if the customers were insulting the driver. The transport of animals is prohibited except in the case of animals (dog) accompanying visually impaired people. In the event that My Private Driver is unable to provide the vehicle provided for in the contract, the deposit will be refunded, unless both parties agree on the provision of another vehicle. Mon Chauffeur Prive reserves the right not to perform the service in the event of the occurrence of a case of force majeure, a fortuitous event, due to a third party or any event that may pose a risk to the customer, his guests, his attendants, the driver or the vehicle. In this context, the total or partial non-performance of the service cannot give rise to any compensation from the customer. My Private Driver is not bound by any obligation to keep luggage, or any other objects, goods, clothing, effects, etc. left in the vehicle during and at the end of the service. Note that all the photos communicated on our documents and website are for illustrative purposes and not contractual.

Article 8: Insurance

The liability of the company Mon Chauffeur Prive is limited to the clauses of its insurance contracts. Our vehicles are insured for the transport of people and our travelers for all bodily injuries and also for professional civil liability with our insurer MAAF. The client will have the right to take out additional insurance at his expense for cancellation costs, repatriation costs or the coverage of the luggage transported, without this list being limiting.

Article 9: Police and security rules

The vehicle and the driver will be provided with the on-board documents necessary for the smooth running of the transport service. In accordance with the law in force in all public places, it is strictly forbidden to smoke on board our vehicles. In accordance with the provisions of the drinking establishments code, it is forbidden to consume alcoholic beverages on board our vehicles.
